PROBATE
The probate process ensures an orderly transfer of ownership after a person's death. Probate proceedings are also used to determine who inherits from a person who did not do adequate estate planning (such as a will) while alive. If the person who died prepared the appropriate documents, usually probate in Texas is not difficult. After someone's death, loved ones should consult a lawyer to determine whether probate is necessary; if it is, action should be taken before four years have gone by. However, do not assume probate is not needed just because the person who died left a surviving spouse.

Consider a guardianship legal protection set by the court system for someone who is mentally or physically incapacitated. Guardianships are established for adults who have lost their ability to manage their own affairs due to illness or other conditions.
